Kejriwal’s Interim Bail: Supreme Court’s Decision Amidst Political Unrest
Kejriwal Granted Interim Bail by Supreme Court:
Amid the election confusion, Delhi Chief Minister Arvind Kejriwal has received some positive news. He has been give bail by the Supreme Court, which will last until June 1. Kejriwal’s bail request was rejected by the Enforcement Directorate (ED). Apart from this, moves are being made to link Aam Aadmi Party to the liquor scam.
Kejriwal was given provisional bail that expires on June 1 and requires his surrender on June 2. About the publicity issue, Kejriwal will be released from jail. At once, the ED rejected temporary release and developed a clear approach to encircle Kejriwal and his Aam Aadmi Party. Kejriwal was named by the ED as the primary suspect in the alcohol scam.
1. The ED claimed that a politician is not allowed to any different treatment than a regular citizen. They are subject to police powers in the same manner as any other citizen upon breaking the law.
2. It was mentioned in the Deputy Director’s affidavit that trying to treat a politician differently from a farmer or businessman is unjustified.
3.The affidavit declared that there would be a violation of Article 14 if the election campaign was used as support for temporary bail. Similarly, any politician could demand bail for taking part in an election campaign, just as a farmer could demand bail for farming or a director of a company could demand bail for attending an annual meeting.
4. According to the agency, running for office is both a fundamental, legal, or legal right.
5. It was claimed in the affidavit that till now no politician has been granted temporary bail for election campaign.
6. The ED quite far argued that since there have been about 123 elections in the previous five years, no politician can be detained or placed under custody if temporary bail is granted for campaigning.
In the meantime, the Delhi liquor scam saw the holding of another important hearing. The ED has received a notice from the High Court requesting a response within two weeks. The lower special court had rejected Kavita’s bail application. Accepting the arguments of the ED, High Court Judge Swarnakanta Sharma denied Kavita bail. Kavita will now file a Supreme Court appeal against the High Court’s ruling.
